Plaintiff and appellant Conchita Franco Serri brought this action against her former employer (defendant and respondent Santa Clara University (the University)) and other individually named defendants after the University terminated her employment. Serri had worked as the University's Director of Affirmative Action since 1992. The University terminated her employment in 2007 because she failed to produce Affirmative Action Plans for three consecutive years, even though her job required that she produce an Affirmative Action Plan annually. The University also terminated her employment because she made misrepresentations about the Plans that she had failed to prepare. Notwithstanding Serri's failure to produce the required Plans-and the misrepresentations she made about the nonexistant Plans-Seri filed a complaint alleging that she was wrongfully discharged from her employment based on her race and ethnic origin. Her complaint also contained causes of action for breach of her employment contract, retaliation and harassment in violation of the California Fair Employment and Housing Act, violation of the federal Equal Pay Act, defamation, intentional and negligent infliction of emotional distress, and interference with prospective economic advantage. The defendants moved for summary judgment, or in the alternative, summary adjudication of each of Serri's causes of action.

And Senator Howard Baker (R-TN), the vice chairman of the Senate Watergate investigative committee, has alluded to mysterious links between the CIA and the Nixon White House. Whenever the courts push back against the administration's unsupportable constitutional ideas—ideas about "inherent powers" and a "unitary executive" or the silliness of the Geneva Conventions or the limitless sweep of presidential powers during wartime—the Bush response is to repeat the same chorus louder: Every detainee is the worst of the worst; every action taken is legal, necessary, and secret.

Instead, Villaraigosa engaged in a cocksure, self-righteous invective about the need to "enforce the law," declaring that all members of the community need to respect the law or be held accountable, boastfully adding (in paraphrase), "if the chief, I, or anyone else breaks the law, we would be held accountable," knowing as an attorney, that he and the chief had already broken the law, as Judge Kim R. Rocky Nichols, executive director of the Disability Rights Center of Kansas, said the lobbying portion of the bill is redundant because PAIMI groups already are prohibited from using their federal funding for political advocacy.

A possible civil rights speech topic could focus on how the addition of a mandatory “gender identity or expression” clause to non-discrimination policies across the country would help to create equal opportunity in the workplace for transgendered employees. Decades after the peak of the civil rights movement, activists for a variety of causes continued to employ strategies such as sit-ins and other forms of civil disobedience popularized by civil rights groups.

Since the newly formed African republics were so concerned about discrimination in the United States (and since these nation-states were highly courted as potential Cold War pawns) what prevented them all from simply aligning with the Soviet Union? An investigation found that the jail systematically violated inmates’ constitutional rights by the use of excessive force by staff, the failure to protect inmates from harm by fellow inmates, inadequate medical and mental health care, and a lack of adequate fire safety and sanitation.

Some black leaders commented ruefully that the civil rights movement stopped in Perry, a small town to the south of Atlanta. Marineau, was brought by the ACLU-VT in 2004. EPIC argued that the Intelligence Court exceeded its legal authority and could not compel a telephone company to disclose so much personal information unrelated to a foreign intelligence investigation. Rather, plaintiffs must identify a specific employment practice common to all class members to satisfy Rule 23(a)(2).

The Albany Democrats had expressed loyalty to the Union but had censured the Lincoln administration for what it called unconstitutional acts, such as military arrests of civilians in the North. It's disturbing to hear an elected councilman not only disregard the Law in the Court's holding, but also reality, as voiced by homeless city constituent, "Edward Jones, a plaintiff in the original ACLU lawsuit who still lives on Skid Row," lamenting LAPD's draconian, class cleansing tactics, saying as the Court did, "I am out here because I can't afford to live anywhere else."
